Terms of use

1. Agreement

These Terms of Use ("Terms") govern your use of the Tolyfit mobile app and related services (the "App"), provided by Tici Commerce, Baku, Azerbaijan ("Tolyfit", "we", "us").

By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

You must be at least 16 years old to use the App. If you are under the age of majority where you live, you may use the App only with the consent of a parent or guardian.

2. Health and safety

Tolyfit is a fitness tracking and planning tool. It is not a medical service and does not give medical advice.

• Consult a doctor before starting any exercise program, especially if you are pregnant, injured, or have a heart condition, high blood pressure or another medical condition.
• Stop exercising immediately and seek medical help if you feel pain, dizziness, faintness or shortness of breath.
• Use correct form, appropriate weights and a spotter where needed. Exercise guides and videos in the App are for general information only.
• Calorie, volume and other figures shown in the App are estimates.

You exercise at your own risk. To the extent permitted by law, Tolyfit is not responsible for any injury or health problem resulting from your use of the App.

3. AI-generated workout plans

The App can create and adjust workout plans automatically, based on the answers you give in the onboarding quiz and the workouts you log.

• Plans are generated by software and are not reviewed by a coach or medical professional.
• Plans depend on the information you provide. Keep your goals, experience, equipment and any injuries up to date.
• You are responsible for judging whether an exercise, weight or volume is safe for you. Skip or change anything that is not.
• We do not guarantee any particular result, such as strength gain, muscle gain or weight loss.

4. Your account

You sign in with Apple or Google. You are responsible for keeping access to that account secure and for all activity under your Tolyfit account.

You can delete your account at any time in Settings > Delete Account. Deleting your account permanently removes your workout history, plans and profile data, as described in our Privacy Policy. Deleting your account does not cancel an active subscription; see section 5.

We may suspend or close your account if you break these Terms or misuse the App.

5. Tolyfit Pro subscriptions

Some features require a paid Tolyfit Pro subscription, offered on a monthly or yearly basis. Prices are shown in the App before you buy and may vary by country.

• Payment: charged to your Apple ID or Google Play account when you confirm the purchase.
• Auto-renewal: your subscription renews automatically at the end of each period, at the then-current price, unless you turn off auto-renew at least 24 hours before the period ends.
• Free trials: if a free trial is offered, you are charged when it ends unless you cancel at least 24 hours before. Any unused part of a trial is forfeited when you buy a subscription.
• Cancelling: manage or cancel in your device settings (iPhone: Settings > [your name] > Subscriptions; Android: Google Play > Payments & subscriptions). Cancelling stops future renewals; you keep access until the current period ends.
• Refunds: purchases are processed by Apple or Google, and refund requests are handled under their policies. We cannot issue refunds directly.
• Restoring: use "Restore purchases" in the App to restore a subscription on a new device.

We may change prices or features of Tolyfit Pro. Price changes apply from your next renewal, and Apple or Google will notify you as required.

6. Using the App

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own non-commercial fitness purposes.

You agree not to:

• copy, resell, or redistribute the App, its exercise library, videos or workout plans;
• reverse engineer, scrape, or interfere with the App or its servers;
• use the App for anything unlawful, or upload content that is offensive or infringes someone else's rights.

Your content. You own the data you add, such as workout logs, custom exercises, templates and body measurements. You give us permission to store and process it to run the App for you. When you share a workout card outside the App, you decide where it goes and who sees it.

Our content. The App, its design, logo, exercise content and software belong to Tolyfit or its licensors. These Terms do not give you any rights to them beyond the licence above.

7. Other terms

Privacy. How we collect and use your data is explained in our Privacy Policy.

Third-party services. The App relies on services such as Apple, Google, Firebase and RevenueCat. Their own terms apply to your use of them, and we are not responsible for them.

Availability. We aim to keep the App running but do not guarantee it will always be available, error-free, or that your data will never be lost. The App is provided "as is" and "as available".

Limitation of liability. To the extent permitted by law, Tolyfit is not liable for indirect or consequential losses, and our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, or your statutory rights as a consumer.

Apple App Store. These Terms are between you and Tolyfit, not Apple. Apple is not responsible for the App or its content, has no obligation to provide support, and is a third-party beneficiary of these Terms with the right to enforce them.

Changes. We may update these Terms. If the changes are material, we will tell you in the App before they take effect. Continuing to use the App after that means you accept the new Terms.

Governing law. These Terms are governed by the laws of Azerbaijan, and disputes go to the courts of Baku, Azerbaijan, unless the law of your country of residence requires otherwise.
